City Task Force Mulls Marijuana Dispensary Guidelines

SAN DIEGO -- The city of San Diego's newly formed Medical Marijuana Task Force continued to listen to both sides of the medical marijuana debate Friday, mostly regarding guidelines for local dispensaries.

Parents have expressed concern about drugs near local schools, but at the same time patients worry they're pain-relieving medication will be out of reach. [read more]

Should Medical Marijuana be Taxed Like Cigarettes and Alcohol?

Gray areas in pot law help the ill, and those who are not

LAKE FOREST, CA - Michael Hawkins, a jolly looking man in loafers and a button down shirt, walks into King's Smoke Shop and asks for the cheapest pipe they've got.

Hawkins just came from one of five medical marijuana dispensaries that surround King's on the second-floor of a strip mall at Raymond Way and El Toro Road, and he's carrying a small paper bag containing cannabis called "OG Cush" – the type that he says stops his unbearable head aches and stimulates his appetite but doesn't make him feel high [read more]

CALL TO ACTION: Los Angeles May Lose Their Local Dispensaries Early November

A proposal to ban all sales of medical marijuana in the city is unlikely to be taken up next week. Aides to Councilman Smith say he supports the ban and believes it would force most dispensaries to close...
[full article]

What does this mean for the medical marijuana patients in Los Angeles? The existence of your local dispensaries is at stake. Sure there are other cities around (thankfully) within a reasonable distance but this, to me, would seem like an anti-green move.

What this would do is force patients to commute the already congested streets and highways of Los Angeles increasing traffic and pollution. Apparently sitting in LA traffic, breathing in the smog and pollution from other vehicles is safer for you than inhaling marijuana. How about the cost of gas your car would need to consume to get you from home to your dispensary and back. Some just don't have the money for that, especially during these trying times.

If the City Council of Los Angeles passes this ban, they will be doing a huge disservice, to its very own citizens, in a number of ways. The greatest disservice this would bring to patients is that they would be affected by essentially being forced to drive further to obtain their medications. In this instance it is a clear demonstration of the lack of compassion. When you delay someone's relief from pain and suffering, you become a tyrant.

So what can you do?
Contact you Councilman and respectfully share with them your position on this proposed ordinance. The time to take action is seriously RUNNING OUT. Here is a link that will help you find the contact information for your local representative:

Los Angeles Top Prosecutors Shutting Down Illegal Dispensaries

Even after Monday's announcement by the Obama administration not to pursue medical marijuana patients and caregivers, we still have some prosecutors obviously not getting the memo. Or are they? There is no doubt there are dispensaries out there that are operating illegaly, turning a huge profit and are care only about the money. For those dispensary owners, all I can say is..."You are in the wrong business. This is not to be the business of GREED, but the business of COMPASSIONATE CARE". Marijuana to legitimate patients is not party time, it is a time for our healing. ~ Dr. Herbalist

LOS ANGELES – Clay Tepel knew there were risks to setting up a medical marijuana shop: it could lose money, be robbed or be raided by authorities.

Still, he wasn’t expecting the phone call one August day when a voice said the police were outside and he needed to open up or they would bust down the door.  His first thought, that it was a joke, turned to terror when he opened the door.

Heavily armed officers in helmets, bulletproof vests and, oddly enough, Bermuda shorts stormed his store, handcuffed him, disabled security cameras and seized his drugs before taking him to jail.  When he asked why his shop was invaded, an officer responded, “We’re closing them all down.”

Those words could prove prescient after Los Angeles County District Attorney Steve Cooley said last week that he wanted to shutter clinics that sold pot for profit.  Cooley’s plan is the latest salvo in a prolonged conflict in California over whether medical marijuana is having its intended effect or is being abused by the larger population.

Until recently, raids on clinics typically led to federal prosecutions, but Cooley’s remarks and similar ones from Attorney General Jerry Brown signal a new approach to clear the haze left by Proposition 215, the 1996 state ballot measure that allowed sick people with referrals from doctors and an identification card to smoke pot.

“Everybody is scared,” said Tepel, who has spoken with other pot store operators.  “Why are voters’ rights being stepped all over? This kind of blind justice has to stop.”

The crackdown is a crushing blow for dispensary owners who were relieved in March when U.S.  Attorney General Eric Holder said federal agents would go after marijuana distributors who violated both federal and state laws.

A new policy memo issued Monday by the Justice Department told prosecutors that pot-smoking patients or their sanctioned suppliers should not be targeted for federal prosecution in states that allow medical marijuana.  The guidelines do, however, make it clear that federal agents will go after people whose distribution goes beyond what is permitted under state law or use medical marijuana as a cover for other crimes.

The comments that Holder made this year appear to have emboldened entrepreneurs as marijuana shops cropped up across California.  In Los Angeles alone, there are an estimated 800 dispensaries, more than any other city in the nation.  In 2005, there were only four, authorities said.

Cooley contends a vast majority of several hundred outlets his office investigated aren’t following state law.  Initially, the law allowed authorized marijuana users to grow their own plants, but lawmakers revised the law in 2003 to allow collectives to provide pot grown by members.

Cooley said he would target stores who were profiting and selling to people who don’t qualify for medicinal marijuana.

“All those who are operating illegally, our advice to them is to shut down voluntarily and they won’t be subject to prosecution,” Cooley told The Associated Press on Wednesday.

At the same time, advocates are gathering signatures to get as many as three pot-legalization measures on next year’s ballot in California.  One poll shows voters would support legalizing marijuana outright.  Thirteen states, including California, allow medical marijuana.

Cooley said his office had been assessing the rush of marijuana dispensaries for the past two years and had provided training for his staff during the past several months in anticipation of filing cases.

“Holder’s statement probably created the impression that there wasn’t going to be any federal investigation or prosecution of these entities,” Cooley said.  “There has to be some clarification.”

Message in a Bottle Complete

Message in a Bottle: Something I ran across on the internet that was worthy of sharing

The other day I found a bottle floating in my swimming pool with a message in the bottle! This is what it said:

(Part 1)

Dear American People,

I am writing to thank all you good people for your support of the Drug War. I urge you to please continue to do so. The recent passing of medical marijuana initiatives has me worried and I don't want it to affect the status quo. You complacent Americans have been so good to me over the years - I'd hate to see a change in our relationship. As a drug dealer I depend on your apathy for my livelihood. I'm not just a drug dealer, I'm a Made-in-America drug dealer and proud of it. When Ronald Reagan cut down the marijuana fields of Latin American I responded by making marijuana America's #1 cash crop. Not only did I pick up the slack, but by using American know-how and ingenuity I cultivated a far better crop than our neighbors down South ever could. Thanks to past U.S. successes at cutting off the flow of cocaine into this country, American made methamphetamine is now the drug of choice of many kids in the Midwest. It makes me proud to be an American!

You know what I love best about the Drug War? It's easier for teenagers to buy drugs from me than it is for them to buy a six-pack of beer. Ain't that grand? I love it! Some kids are smart, they just want to try marijuana and have no interest in moving onto the hard stuff. But as long as I'm around they will, oh yes, they will. You see, every once and awhile the feds do too good a job and actually bust one of my indoor growing operations. When the kids come looking for weed and it's out of stock I always like to push the brown heroin. Strong enough that you don't need to inject it, makes it safer is what I always tell them. Like I give a damn. I don't touch the stuff myself, I'm in it for the money. And there is plenty of money to be made. $$$. Now I've got your attention! I'll get back to the money later.

As I was saying, I like to push the hard stuff whenever I can. The beauty of our current arrangement (you: good citizens against drugs, me: evil drug dealer) is that as newer, more potent, more dangerous drugs are introduced they've got a great distribution network already in place, ensuring that America's children won't miss out. Hell, if marijuana had been legalized in the 70's there never would have been a crack epidemic in the 80's or a crank epidemic in the 90's and me and my organized crime buddies would be out of business. Hint: do not support legalized marijuana. Brown heroin is really starting to take off and I'd hate to see a good thing end. Sure the crime rate will go up, HIV will spread and kids will be stealing from their own grandmothers but we should not rock the boat. You people get to say you're against drugs and I get filthy rich pimping American children. Let's keep it that way.

Message in a Bottle, Continued...Part deux:

Let me get back to the money now because I know those dollar signs I flashed earlier got you all excited. I do admit that I make far more money than I need and I don't pay taxes on any of it. Who cares if the U.S. government could make millions off of legalization? Who cares if a bag of pot I sell for $200 costs me about 75 cents to grow? Taxes are un-American and the reason this country fought a war back in the 18th Century. Some say that if you legalized drugs the cost of an addict's habits would go down and the crime rate with it. It may be true that a job at a McDonald's would buy enough crack to keep an addict high all night if it were legal but I give you one very compelling reason against legalization: jobs. This Drug War of ours doesn't just keep me in the money. Think about the hard working folks at ONDCP, DEA, NIDA, FBI, DOJ, DOD and all our boys in blue. We owe it to them to continue funding the Drug War. Think about the prison system and all the jobs it creates.

America has the highest per capita rate of incarceration in the world. I say, let's build more prisons! Some of my best customers are in prison and I make sure they continue to receive their favorite drugs while behind bars. An added bonus for all you closet racists: the prison population is disproportionately black. Thanks to the Drug War Americans have seen their civil rights watered down substantially. Who needs civil rights? I don't. I need increased funding for the Drug War. Now some of you may have heard talk about "harm reduction" and registering addicts. Don't support such nonsense! First of all, you would destroy the organized crime network which means I would be out of job. Second, by destroying organized crime you would deny future generations the joys of heroin and crack addiction. Third, you would eliminate drug-related violent crime, which would make Hollywood movies really boring. Believe me, I will not be organizing any more drive-by shootings unless large sums of money are involved. The drugs are irrelevant, I don't touch the stuff, the money is everything. I'm sure you can relate to that.

Finally, the main reason for not adopting harm reduction strategies and providing registered addicts with hard drugs is that it leads to big government. Big government bad. Drug War good. (Repeat 10 times.) Leave the drug distribution to professionals like myself. In conclusion, please continue to support the drug war. Remember: drugs are bad. Maintain the status quo. Continue to lump all drugs together. So long as marijuana, LSD, cocaine and heroin are all lumped together kids will reject the anti-drug message in its entirety and my business will boom. Kids aren't stupid but I do appreciate it when government treats them as if they are. By the way, for those of you in the media I applaud the suppression of the many studies that concluded that marijuana is safer than alcohol or tobacco. We can't let that sort of information get out as it poses a serious threat to the Drug War. Also for the media, please continue to spread lies about medical marijuana. Let's keep everything black and white or before you know it American will be like the Netherlands - we'll have the lowest rate of drug use on the Western Hemisphere - and I'll be out of a job. Again, I thank you for your support of the Drug War. God bless.

Crackdown on Los Angeles County Dispensaries has been Announced by D.A.

Los Angeles County District Attorney Steve Cooley said that he would be prosecuting medical marijuana dispensaries for over the counter sales which has been the standard practice of dispensing medical marijuana under an initiative approved by California voters over a decade ago.

Cooley claims that 100% of the dispensaries in Los Angeles County are operating illegally and the time to put an end to that is NOW. What does this mean for our dispensaries and our patients? That remains to be seen.

VIDEO: Los Angeles Medical Marijuana Clinic Controversy

Can someone please tell me how a cancer patient that can barely move, let alone get out of bed, is going to go to cultivate their own medicine. What kind of shit is that!?

Each dispensary is different and there needs to be some standardization so everybody is on the same page and not stepping on somebody else's toes. When marijuana starts to be taxed and regulated like alcohol...although Vicodin isn't taxed like Alcohol....hmm? Anyway, once the money starts flowing into the cities and state, I think more and more individuals will realize the financial benefits that have been ignored all these years.

It is time the politicians, the ones that put their own personal agendas before the wishes of the people, either get on the same page or face being voted out of office in the next elections. We will all be watching where you stand on the issues that matter the most to us; the voters.
